Grading Submission Agreement

Please read carefully. By submitting cards to The Asylum for grading, you ("Customer," "you") agree to this Grading Submission Agreement (the "Agreement") with The Asylum ("we," "us," "our"). If you do not agree, do not submit cards.

1. Our Role

We are a submission intermediary. We review, prepare, and submit your cards to a third-party grading company you select (PSA, Beckett/BGS, CGC, or SGC), and arrange their return to you. We are not a grading company and are not affiliated with, or acting on behalf of, any grading company. Grades and authenticity determinations are made solely by the grading company under its own terms.

2. No Guarantee of Grades or Outcomes

We do not promise, predict, or guarantee any grade, designation, turnaround, or outcome. Cards may receive a low grade, a qualifier, an "authentic only" or "altered/evidence of trimming" designation, may be deemed ineligible, or may be returned ungraded. Any estimates we provide are opinions, not commitments, and are not a basis for any claim against us.

4. Shipping & Risk of Loss

You are responsible for safely packaging and shipping your cards to us, at your own risk and expense. We strongly recommend tracked, insured shipping. Risk of loss passes to us only upon our confirmed receipt, and returns to you upon hand-off to the return carrier. Return shipping is arranged with tracking and insurance up to the declared value, at your cost as quoted.

6. Turnaround Times

All timeframes are estimates and depend on the grading company's queue and factors outside our control. Delays are not grounds for a refund of paid fees.

7. Your Representations

You represent and warrant that you own the cards (or are authorized to submit them), that they are authentic and not counterfeit, altered, or trimmed to your knowledge, and that they are not stolen or subject to any dispute. Submitting cards that violate this section is a material breach.

8. Right to Refuse or Return

We may decline, hold, or return any card at our discretion — including suspected counterfeit, altered, stolen, or ineligible items — and may report suspected illegal activity. Declined cards are returned at your expense; review fees remain non-refundable.

9. Unclaimed or Abandoned Cards

If an invoice or returned shipment goes unpaid or a submission remains unclaimed for ninety (90) days after we notify you at the contact information you provided, a reasonable storage fee may apply, and cards may be deemed abandoned and disposed of or sold to recover amounts owed, to the extent permitted by law.

10. Grading Company Terms

Your cards are also subject to the submission terms, liability limits, and policies of the selected grading company. Those terms govern the cards while in the grading company's possession, and you agree to them by submitting.

11. Indemnification

You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your breach of this Agreement or from the cards you submit, including any authenticity or ownership dispute.

12. Disclaimer & Force Majeure

Services are provided "as is" without warranties of any kind to the fullest extent permitted by law. We are not liable for failures or delays caused by events beyond our reasonable control (including carrier failures, grading-company backlogs, theft, fire, or natural disaster).

13. Governing Law & Disputes

This Agreement is governed by the laws of the State of New Hampshire, without regard to conflict-of-law rules. You agree that any dispute will be resolved in the state or federal courts located in New Hampshire.

14. Communications Consent

You consent to receive submission-related communications (email/SMS/phone) at the contact information you provide.

15. Entire Agreement & Changes

This Agreement is the entire agreement regarding your submission and supersedes prior understandings. We may update it; the version in effect when you submit (recorded with your submission) governs that submission.

By checking the acceptance box and submitting your cards, you confirm you have read, understood, and agree to this Agreement. We record the version, date, and time of your acceptance with your submission.
