These Terms of Service ("Terms") govern your use of theasylumcollective.com and our related services, including our shop, live breaks, grading submissions, The Vault, and trades (the "Services"), operated by Asylum Breaks LLC ("The Asylum," "we," "us," "our") from New Hampshire. By using the Services, creating an account, or making a purchase, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
You must be at least 18 years old to make a purchase, enter a break, or transact through the Services. Accounts for those under 18 are permitted only with the involvement and consent of a parent or legal guardian, who is responsible for all activity. The Services are not intended for children under 16.
You agree to provide accurate information, keep your login credentials secure, and are responsible for all activity under your account. Notify us of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are involved in fraud or abuse.
We ship to the address you provide. Title and risk of loss pass to you when we hand the package to the carrier. Delivery estimates are not guarantees. We are not responsible for carrier delays, loss, or damage in transit, though we will reasonably assist with a claim where shipping insurance applies.
A "break" is a group opening of sealed product in which you purchase one or more spots (for example, a team, division, or randomized slot). By entering a break you understand and agree that:
The Vault is a collection-tracking tool. Estimated values are automated estimates drawn from third-party price sources, provided for informational purposes only. They are not appraisals, guarantees of value, or financial, investment, tax, or insurance advice, and may be inaccurate or out of date. Do not rely on them for buying, selling, insuring, or valuing decisions. You are responsible for the data you enter and for keeping your own records; we may modify or discontinue the feature at any time.
The Vault may let you arrange trades with other users. The Asylum provides the tool only and is not a party to, and not responsible for, any user-to-user trade. We do not verify items, ownership, authenticity, condition, or that any trade is completed. You transact entirely at your own risk, and any dispute is solely between the users involved.
You retain ownership of content you submit (such as Vault entries and messages) and grant us a non-exclusive license to host and use it to operate the Services. You agree not to use the Services to: deal in counterfeit, stolen, altered, or infringing items; harass or defraud others; misrepresent items or yourself; scrape or overload the Services; or violate any law. We may remove content and suspend accounts at our discretion.
The Asylum's name, logos, and site content are owned by us or our licensors and may not be used without permission. We grant you a limited, revocable license to use the Services for their intended personal, non-commercial purpose.
The Services rely on and link to third parties (including Whatnot, Stripe, PayPal, Discord, and grading companies). Your use of those services is governed by their terms, and we are not responsible for them.
The Services are provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. Card values fluctuate and are outside our control. We do not warrant that the Services will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, The Asylum is not liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits or lost collectible value. Our total liability arising out of or relating to the Services or any transaction is limited to the amount you paid us for the transaction giving rise to the claim.
You agree to indemnify and hold The Asylum harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the Services, your content, your transactions, or your breach of these Terms.
We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Provisions that by their nature should survive termination (including Sections 5–14) will survive.
These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law rules. You agree that any dispute will be resolved in the state or federal courts located in New Hampshire, and you consent to their jurisdiction.
We may update these Terms from time to time. We will post the updated version here with a new "Last updated" date, and your continued use of the Services after changes take effect constitutes acceptance.
